Would-Be Terrorist Thwarted in Tampa, Florida

The Associated Press reports that a would-be suicide bomber has been arrested in Tampa, after attempting to purchase materials he planned to use in a “terrifying” attack:
A 25-year-old man from the former Yugoslavia was charged with an alleged plot to attack crowded locations in the Tampa area, including night clubs, with a car bomb, assault rifle and other explosives, federal authorities said Monday.
The U.S. Department of Justice announced the arrest of Sami Osmakac, whose first appearance in federal court was scheduled for 2 p.m. Monday.
Authorities say Osmakac, from Pinellas County, is a naturalized U.S. citizen who was born in the former Yugoslavia. He has been charged with one count of attempted use of a weapon of mass destruction.
Chalk up another big score for Fake Bombs, Incorporated, a subsidiary of the FBI which has been enjoying brisk sales despite the depressed economy. This particular order was huge:
On Dec. 21, Osmakac met with the undercover agent and allegedly told the agent that he wanted to buy an AK-47-style machine gun, Uzi submachine guns, high capacity magazines, grenades and explosive belt. During a later meeting, Osmakac gave the agent a $500 down payment for the items.
"According to the complaint, Osmakac also asked the undercover employee whether he/she could build bombs that could be placed in three different vehicles and detonated remotely, near where Osmakac would conduct a follow-up attack using the other weapons he requested," the press release said. "The undercover employee said he/she could possibly provide explosives for one vehicle. Osmakac also allegedly said that he wanted an explosive belt constructed to kill people."
Osmakac was also looking to get some al-Qaeda flags, and had already produced his martyrdom video. His targets would have included the Hillsborough County Sheriff’s Office Operations Center in Ybor City, and a crowded pub in South Tampa called MacDinton’s, according to the Tampa Tribune… which offers a few details that haven’t been widely reported by the national media as of yet:
"I want to do something terrifying," [Osmakac] said, according to a federal complaint, "like one day, one night, something's going to happen. Then six hours later, something else."
[…] On New Year's Day, according to the complaint, he was given the chance to back out of the plot. But he declined, saying, "We all have to die, so why not die the Islamic way?" In discussing a possible Ybor City attack, Osmakac told an undercover agent he wanted to detonate a car bomb near a nightclub on a night when there would be a lot of people in the area, according to the complaint.
"I know a lot of places where it gets real crowded," he is quoted as saying.
He also told the agent he wanted to "take down buildings" and "kill people inside," the complaint states.
(Emphases mine.) The local Muslim community provided assistance leading to the arrest, prompting an expression of gratitude from U.S. Attorney Robert O’Neill and the FBI:
O'Neill and Tampa's FBI chief, Steven E. Ibison, met with local Muslim leaders this morning to discuss the arrest, according to Hassan Shibly, executive director of the local office of the Council on American Islamic Relations.
Authorities wanted to thank the Muslim community for its help and assured it that Osmakac was considered a "lone wolf," Shibly said.
Shibly said Osmakac was banned from two local mosques, and local Muslims were so concerned about his extremist views that they reported him to law enforcement. His views were so extreme, Shibly said, that there were fears he might be mentally unbalanced.
Osmakac "had absolutely no support in the local Muslim community," Shibly said.
However, Shibly made a point of saying the Muslim community would be “very concerned” if Osmakac’s planned terror rampage was something “instigated by the government” in their zeal to make an arrest.

Robert stacking the deck of Justice
Wow. This is like stepping outside to play with the dirty little street ruffians (bronx et. al NOT ALL BRONX) .. you know the type ... those who don't have the ability to WIN FAIRLY. So instead they "win" by subverting everything to their favor.
And that's all you have done Robert. You have destroyed the fabric of the United States of America to suit your inability to win by having any actual expertise or knowledge.
In court you'd lose every time. As you know.
So you stacked justice in your favor. I hope sincerely we are well acquainted so I am privy to your deathbed musings.
Regret: hard to swallow.

The Robert O'Neill stable of ... ummm ... people
Victim in DUI-manslaughter case deserved better, and so did the Marine charged with killing him

A DUI-manslaughter trial is about the saddest thing you can sit through.
Usually the victim was someone just driving along trying to get where he was going. The accused often has no record, just that colossally stupid moment when he slid behind the wheel and turned the key. Lives get ruined for nothing, and no number of prison years will make it right.
The DUI-manslaughter case against Scott Sciple, a Marine who saw intense combat but never got the mental help he needed in a warrior culture that discourages weakness, takes that kind of loss and sadness up a notch.
To be clear, it's hard to imagine a more innocent victim than Pedro Rivera, a father, husband and mother's favorite son killed last year. A mechanic, he was headed home after a late-night mercy mission to help a friend on the highway when Sciple came driving the wrong way on I-275. Police said he'd had three times the legal limit.
So it would be easy to dismiss Sciple as a man deserving any punishment a judge could come up with. But his case turns out to be about responsibility, too, to people who serve in our military, live through what we could not imagine and are marked by it.
As the Times' John Barry recently reported, Sciple was a war hero who served in Iraq and Afghanistan, survived four combat tours and was awarded three Purple Hearts and a Bronze Star for valor. He saw dead children and mass casualties and saved wounded fellow Marines. He kept going back. He was riddled with shrapnel and a rocket blast blew open his arm. And not all his wounds were visible.
He started acting strange, worrying friends, family and colleagues. But he told his father showing weakness could kill a Marine's career.
A Marine Corps report later found he was suffering post traumatic stress disorder and traumatic brain injury and had "dissociative episodes" in which he didn't remember what happened. But he had never gotten a neurological workup. He was seen as fit for duty and sent to MacDill Air Force Base. Less than 48 hours later, an innocent man was killed.
At his trial, the prosecution will likely talk about Sciple's personal responsibility that night, much of which he says he doesn't remember. His attorney, John Fitzgibbons, plans to ask for a verdict of not guilty by reason of insanity. Under the law, he will argue Sciple had a mental infirmity that kept him from knowing what he was doing, or from knowing it was wrong. A not-guilty verdict would put him in treatment instead of prison.
And I would not want to be on that jury, looking into the faces of Rivera's family, and then at the combat veteran at the defense table, a man even the Marines say should have been treated, not sent here.
The Corps' straightforward and unflinchingly inward-looking 860-page report concludes Sciple was "incapable of making fully informed cognitive decisions" and suffered documented memory loss and blackouts. It talks of a flawed system that relies on traumatized combat vets to report on themselves even in a "Marine Corps warrior culture" that stigmatizes it. It talks change.
If any good can come from this, change is it. Change means powerful people in Washington pushing for better rules to evaluate and support the ones we send into battle, to keep this kind of tragedy from happening again.

The story has many flaws. And for instance I know people wounded worse than he who wouldn't harm a fly never mind manage to find enough booze to do this. As well, his family bears responsibility. This is not a hard decision, his family could have called 911 for his protection BEFORE he hurt this other man. Now, after the fact we're all supposed to go: OH MY BAD. I have sympathy and I know he needs help but plenty others get sent to prison even war vets and vietnam vets and nary a blink. What's UP with this one?? Two articles in two days. My son did tell me that it is so true that telling you need help ruins your career. Forget re-enlisting.

Dig a little deeper and you will probably find Sciple was drinking alcoholically before he ever enlisted. That colossally stupid moment the writer alludes to was more than a moment of stupidity. The victim here, and make no mistake it is not Sciple, deserves all the respect being heaped upon Sciple.

Our servicemen are NOT coming back all-right and they are not coming back to much, it is a repeat of Vietnam. Perhaps the Marines (likewise the entire Military) do deserve some blame here, and elsewhere, for failing to take care of their own and bring attention to red flags that an individual is not functioning properly. Still I see a major problem with allowing PTSD as a defense for criminal activity, it opens up a very big can of worms.

But if we start deciding who's sad story ought to give them a pass for killing a guy we are in trouble. The fact that the killer of the innocent was a soldier, well decorated would not allow me to be ok with him going free if he killed my son or daughter. As a society we have to make choices - kill people behind the wheel you gotta pay - err on the side of accountability. And SAVE the it won't bring them back - that logic is a justice killer.

But, for most of us with a more mundane existence, divorce, accidents/health issues/hospitalizations, foreclosures, job loss/firings. We just have to tuff it out and if we get plowed and do something stupid, things just get even worse. It's called reality. Buck up young man, and take your medicine. Your life is not over. After 8-12 years in the pen, maybe you'll be right.

A DUI-manslaughter trial is about the saddest thing you can sit through.
Usually the victim was someone just driving along trying to get where he was going. The accused often has no record, just that colossally stupid moment when he slid behind the wheel and turned the key. Lives get ruined for nothing, and no number of prison years will make it right.
The DUI-manslaughter case against Scott Sciple, a Marine who saw intense combat but never got the mental help he needed in a warrior culture that discourages weakness, takes that kind of loss and sadness up a notch.
To be clear, it's hard to imagine a more innocent victim than Pedro Rivera, a father, husband and mother's favorite son killed last year. A mechanic, he was headed home after a late-night mercy mission to help a friend on the highway when Sciple came driving the wrong way on I-275. Police said he'd had three times the legal limit.
So it would be easy to dismiss Sciple as a man deserving any punishment a judge could come up with. But his case turns out to be about responsibility, too, to people who serve in our military, live through what we could not imagine and are marked by it.
As the Times' John Barry recently reported, Sciple was a war hero who served in Iraq and Afghanistan, survived four combat tours and was awarded three Purple Hearts and a Bronze Star for valor. He saw dead children and mass casualties and saved wounded fellow Marines. He kept going back. He was riddled with shrapnel and a rocket blast blew open his arm. And not all his wounds were visible.
He started acting strange, worrying friends, family and colleagues. But he told his father showing weakness could kill a Marine's career.
A Marine Corps report later found he was suffering post traumatic stress disorder and traumatic brain injury and had "dissociative episodes" in which he didn't remember what happened. But he had never gotten a neurological workup. He was seen as fit for duty and sent to MacDill Air Force Base. Less than 48 hours later, an innocent man was killed.
At his trial, the prosecution will likely talk about Sciple's personal responsibility that night, much of which he says he doesn't remember. His attorney, John Fitzgibbons, plans to ask for a verdict of not guilty by reason of insanity. Under the law, he will argue Sciple had a mental infirmity that kept him from knowing what he was doing, or from knowing it was wrong. A not-guilty verdict would put him in treatment instead of prison.
And I would not want to be on that jury, looking into the faces of Rivera's family, and then at the combat veteran at the defense table, a man even the Marines say should have been treated, not sent here.
The Corps' straightforward and unflinchingly inward-looking 860-page report concludes Sciple was "incapable of making fully informed cognitive decisions" and suffered documented memory loss and blackouts. It talks of a flawed system that relies on traumatized combat vets to report on themselves even in a "Marine Corps warrior culture" that stigmatizes it. It talks change.
If any good can come from this, change is it. Change means powerful people in Washington pushing for better rules to evaluate and support the ones we send into battle, to keep this kind of tragedy from happening again.

The story has many flaws. And for instance I know people wounded worse than he who wouldn't harm a fly never mind manage to find enough booze to do this. As well, his family bears responsibility. This is not a hard decision, his family could have called 911 for his protection BEFORE he hurt this other man. Now, after the fact we're all supposed to go: OH MY BAD. I have sympathy and I know he needs help but plenty others get sent to prison even war vets and vietnam vets and nary a blink. What's UP with this one?? Two articles in two days. The victim here, and make no mistake it is not Sciple, deserves all the respect being heaped upon Sciple.

Our servicemen are NOT coming back all-right and they are not coming back to much, it is a repeat of Vietnam. Perhaps the Marines (likewise the entire Military) do deserve some blame here, and elsewhere, for failing to take care of their own and bring attention to red flags that an individual is not functioning properly. Still I see a major problem with allowing PTSD as a defense for criminal activity, it opens up a very big can of worms.

But if we start deciding who's sad story ought to give them a pass for killing a guy we are in trouble. The fact that the killer of the innocent was a soldier, well decorated would not allow me to be ok with him going free if he killed my son or daughter. As a society we have to make choices - kill people behind the wheel you gotta pay - err on the side of accountability. And SAVE the it won't bring them back - that logic is a justice killer.

But, for most of us with a more mundane existence, divorce, accidents/health issues/hospitalizations, foreclosures, job loss/firings. We just have to tuff it out and if we get plowed and do something stupid, things just get even worse. It's called reality. Buck up young man, and take your medicine. Your life is not over. After 8-12 years in the pen, maybe you'll be right.

TAMPA — Former Hillsborough County Commissioner Kevin White pleaded not guilty to federal corruption charges Thursday and told a judge he can't afford to pay for his own attorney.
So U.S. Magistrate Judge Thomas Wilson named private defense attorney Grady Irvin to defend him at taxpayer expense.
White, 46, was indicted earlier this month on 10 felony charges, including bribery, conspiracy, wire fraud, mail fraud and lying to an FBI agent. Each charge carries a maximum sentence of five to 20 years in prison.
An arraignment for co-defendant George Hondrellis, owner of Tampa City Towing, was postponed another week because he had not yet retained counsel.
The judge set a trial date in August, though that will likely be postponed. White, dressed in a dark pinstriped suit, told a reporter as he left the courtroom, "I have no comment at all."
Irvin said, "We've got a lot of work to do."
The arraignment took all of 10 minutes as Irvin told the judge that White had spent much of Wednesday trying to find a lawyer he could afford. Irvin presented a list of attorneys White had approached and the fees they quoted to take the case.
The judge sealed the record before appointing Irvin.
Judge Wilson asked White directly if he could afford an attorney. White responded: "No, sir, your honor. I cannot."
Had he contacted each of the attorneys on the list presented to the court?
"Yes," White said. "I contacted each one."
Hondrellis faces the same charges as White, a former Tampa police officer and former Tampa City Council member, although only White is charged with lying to the FBI. Both men are free on bail.
U.S. Attorney Robert O'Neill's office says White and his now-deceased father Gerald White accepted $8,000 in bribes and a 2003 Lincoln Navigator last year from three men who sought the favor of the Public Transportation Commission, which White chaired.
The men wanted a permit from the PTC to be put on a lucrative list of towing companies doing work for Tampa police and the Hillsborough Sheriff's Office.
Unknown to White, two of the men worked for the federal government, one as a federal agent and the second as an informant. Hondrellis, federal authorities say, was the third.
White served four years on the County Commission before losing a reelection bid in November, and three years on the City Council before that.
O'Neill said Thursday he will personally try the case.

I wonder has anyone looked at the list of folks whom were handed any permits or licenses for these lucrative contracts on White's or Miranda's watch? (ambulance, tow, LIMO, etc..) and why they were awarded them? Or if there are any other problems. I seem to remember some ambulance permits badly awarded back when Miranda was on city council. Just wonder if the same problems still exists and is being overlooked. This current American ambulance bunch appears to be very shifty. I wouldn't want them coming to my house or even driving by.

I wonder has anyone looked at the list of folks whom were handed any permits or licenses for these lucrative contracts on White's or Miranda's watch? (ambulance, tow, LIMO, etc..) and why they were awarded them? Or if there are any other problems. I seem to remember some ambulance permits badly awarded back when Miranda was on city council. Just wonder if the same problems still exists and is being overlooked. This current American ambulance bunch appears to be very shifty. I wouldn't want them coming to my house or even driving by.

U.S. attorney a veteran at fighting public corruption

O’Neill has a history of prosecuting corruption in Hillsborough.
TAMPA — Two years ago, Robert O'Neill was on a short list to be the top federal law enforcer for the Middle District of Florida.
O'Neill, about to charge a former judge with bank fraud, dropped a hint to the panel interviewing him.
"Public corruption should always be a priority," he said. "If it's there, we need to make sure those cases are being made."
He got the job. And this week, Hillsborough County witnessed for the first time in years the arrest of a government official, Kevin White, on public corruption charges.
To those who know O'Neill, his personal appearance in a courtroom Wednesday was no surprise.
"He is, I think, just personally offended when public officials are being bribed or breaking the law," said Tampa defense lawyer John Fitzgibbons.
O'Neill, 53, grew up in a blue-collar neighborhood in the Bronx, the son of immigrants, a janitor and a maid who met on a service elevator.
His first days as a young prosecutor were spent tackling violent crimes in 1980s New York City. His career took him to Miami during the era of cocaine cowboys, when bodies floated down the river.
Hillsborough County, that decade, saw its own share of excitement: county commissioners in handcuffs.
The U.S. attorney at the time was a legendary hard charger named Robert W. "Mad Dog" Merkle Jr., who garnered both intense criticism and staunch support as he crusaded against Tampa's power elite.
County Commissioners Jerry Bowmer, Joe Kotvas and Fred Anderson had taken bribes in exchange for zoning votes. Merkle's office won their convictions.
But he was often accused of tainting reputations without convincing evidence. He subpoenaed the governor to ask if he had taken bribes. He accused the mayor of being "on the take."
Going after public officials is sensitive business, said Bill Jung, who worked with O'Neill as a federal prosecutor.
"There is a discernment which is most important in public corruption cases," he said. "There's too much at stake."
In 1993, O'Neill served as lead prosecutor in a corruption case against Deborah Gore Dean, a second cousin to Vice President Al Gore.
O'Neill drew criticism when he accused her of lying on the witness stand — "You can take her testimony and throw it in the garbage where it belongs," he said.
He started prosecuting cases that year for the U.S. Attorney's Office in Florida's Middle District, which includes the Tampa Bay area.
In 2001, he successfully prosecuted Audley S. Evans, accused of misappropriating $4.5 million in Tampa Housing Authority funds.
His 2004 prosecution sent Steve and Lynne LaBrake to prison for conspiracy, wire fraud and accepting bribes, after news stories raised suspicions about the man who headed Tampa's housing department.
After the conviction, O'Neill said the verdicts sent a message that public officials should not abuse their positions for personal gain, noting, "This is a serious crime that undermines our system of government."
Over the years, prosecution priorities have evolved, said Todd Foster, a defense lawyer and former prosecutor and FBI agent.
Drugs were big in the 1980s. Priorities shifted heavily to fighting terrorism after the attacks of Sept. 11, 2001.
Fitzgibbons says that since O'Neill's appointment, defense lawyers have noticed an uptick in white collar prosecutions.
Federal investigators have been looking into state Sen. Jim Norman's financial relationship with Ralph Hughes, a now-deceased businessman who gave Norman's wife $500,000 to buy a lakefront home in Arkansas when Norman was a county commissioner.
Last month, O'Neill signed a subpoena for employment records of Norman's legislative aide.
This month, apart from his bribery indictment of White, O'Neill's office filed charges against Ronald Clifton, alleging bribery and false statements made as the mayor and a council member in South Daytona.
O'Neill declined an interview for this story.
His schedule, a spokesman said, was too full.

Anyone who openly states these contractual awards at the 13th Judicial Circuit courthouse are bribe-free is either brain-dead or has a vested stake in this Department of Homeland Security con-game. Oneill will serve "National Security Letters" on any attempt to meaningfully investigate these DHS scammers.
This entire Kevin White corruption ordeal is smoke & mirrors intended by O'Neill to take your eyes off the real corruption occurring on the federal level in the name of "keeping us safe."

O'Neill's appearance in the White case suggests he may be inclined to try it himself. In that regard, I note that the case involves a 18 U.S.C. 1001 false statement claim. Recall the story O'Keefe told everyone regarding the day Judge Sirica phoned him immediately following the Watergare break-in 1st-appearance, when Sirica told O'Keefe he was puzzled as to why the US courthouse hallways were chock-full of top level DOJ attorneys, when the case was supposedly nothing more than a simple break-in?
It was O'Keefe who suggested Sirica nail these Nixon punks irrespective of the threats/intimidation that would most certainly follow.
Do the right thing. Tampa Bay area is where all these retired US Military mucky-mucks attain their rigged $cost$ plus contracts as they milk this phony war on terror; likewise, don't screw-up like your office did w/ the Spellisy case.

U.S. attorney a veteran at fighting public corruption

O’Neill has a history of prosecuting corruption in Hillsborough.
TAMPA — Two years ago, Robert O'Neill was on a short list to be the top federal law enforcer for the Middle District of Florida.
O'Neill, about to charge a former judge with bank fraud, dropped a hint to the panel interviewing him.
"Public corruption should always be a priority," he said. "If it's there, we need to make sure those cases are being made."
He got the job. And this week, Hillsborough County witnessed for the first time in years the arrest of a government official, Kevin White, on public corruption charges.
To those who know O'Neill, his personal appearance in a courtroom Wednesday was no surprise.
"He is, I think, just personally offended when public officials are being bribed or breaking the law," said Tampa defense lawyer John Fitzgibbons.
O'Neill, 53, grew up in a blue-collar neighborhood in the Bronx, the son of immigrants, a janitor and a maid who met on a service elevator.
His first days as a young prosecutor were spent tackling violent crimes in 1980s New York City. His career took him to Miami during the era of cocaine cowboys, when bodies floated down the river.
Hillsborough County, that decade, saw its own share of excitement: county commissioners in handcuffs.
The U.S. attorney at the time was a legendary hard charger named Robert W. "Mad Dog" Merkle Jr., who garnered both intense criticism and staunch support as he crusaded against Tampa's power elite.
County Commissioners Jerry Bowmer, Joe Kotvas and Fred Anderson had taken bribes in exchange for zoning votes. Merkle's office won their convictions.
But he was often accused of tainting reputations without convincing evidence. He subpoenaed the governor to ask if he had taken bribes. He accused the mayor of being "on the take."
Going after public officials is sensitive business, said Bill Jung, who worked with O'Neill as a federal prosecutor.
"There is a discernment which is most important in public corruption cases," he said. "There's too much at stake."
In 1993, O'Neill served as lead prosecutor in a corruption case against Deborah Gore Dean, a second cousin to Vice President Al Gore.
O'Neill drew criticism when he accused her of lying on the witness stand — "You can take her testimony and throw it in the garbage where it belongs," he said.
He started prosecuting cases that year for the U.S. Attorney's Office in Florida's Middle District, which includes the Tampa Bay area.
In 2001, he successfully prosecuted Audley S. Evans, accused of misappropriating $4.5 million in Tampa Housing Authority funds.
His 2004 prosecution sent Steve and Lynne LaBrake to prison for conspiracy, wire fraud and accepting bribes, after news stories raised suspicions about the man who headed Tampa's housing department.
After the conviction, O'Neill said the verdicts sent a message that public officials should not abuse their positions for personal gain, noting, "This is a serious crime that undermines our system of government."
Over the years, prosecution priorities have evolved, said Todd Foster, a defense lawyer and former prosecutor and FBI agent.
Drugs were big in the 1980s. Priorities shifted heavily to fighting terrorism after the attacks of Sept. 11, 2001.
Fitzgibbons says that since O'Neill's appointment, defense lawyers have noticed an uptick in white collar prosecutions.
Federal investigators have been looking into state Sen. Jim Norman's financial relationship with Ralph Hughes, a now-deceased businessman who gave Norman's wife $500,000 to buy a lakefront home in Arkansas when Norman was a county commissioner.
Last month, O'Neill signed a subpoena for employment records of Norman's legislative aide.
This month, apart from his bribery indictment of White, O'Neill's office filed charges against Ronald Clifton, alleging bribery and false statements made as the mayor and a council member in South Daytona.
O'Neill declined an interview for this story.
His schedule, a spokesman said, was too full.

JoMa puts up inspirational messages in the Rays clubhouse, along the lines of, integrity not needing rules etc.
Maybe all elected officials, city.county,state and federal (R and D) should put O'Neill's message up in their office.

Anyone who openly states these contractual awards at the 13th Judicial Circuit courthouse are bribe-free is either brain-dead or has a vested stake in this Department of Homeland Security con-game. Oneill will serve "National Security Letters" on any attempt to meaningfully investigate these DHS scammers.
This entire Kevin White corruption ordeal is smoke & mirrors intended by O'Neill to take your eyes off the real corruption occurring on the federal level in the name of "keeping us safe."

Dean was initiated by the convicted defendant, when in fact the investigation was initiated by Bar Counsel itself after reading a court of appeals opinion “deplor[ing]†O’Neill’s conduct. I suggested that O’Neill would be wise to avoid circumstances where he might be asked if he lied on his US Attorney application. I was referring to speaking engagements. But the same point applies to interviews by the press.
